Wage Claims

Wage and Hour Claims Attorneys in New York

Employers are required to obey federal and state wage and hour laws and to pay you proper wages. These laws include minimum wage, overtime (1½ times your regular hourly rate for all hours worked over 40 in any given week) and prevailing wage rates (for work performed on public works or government funded projects).

For experienced representation in wage and hour claims, turn to our legal team at the law firm of Raff & Becker, LLP in New York City. Our partners have over 30 years of experience providing employment law representation to employees that are dealing with issues that affect their futures. We work to help clients understand their rights and options for their wage and hour claims.

A frequent issue our lawyers deal with is the misclassification of employees. This means an employee is labeled as exempt (salaried) instead of non-exempt (hourly). If an employee is clearly doing hourly work and is expected to work overtime, he or she may be entitled to retroactive overtime wages after obtaining the correct employment classification.

  • New York State has a number of other laws that may affect what you are entitled to be paid and the hours you are required to work. They include spread of hours pay (where you work more than 10 hours in a day), mandatory meal breaks, restrictions on tip sharing in the restaurant industry, and the manner in which the employer pays you. Also, employers are limited with regard to the types of deductions they can take from your wages. For example, if you accidently break something on the job, the employer cannot just deduct the replacement cost from your next pay check.
  • If you believe you are not being paid the correct wage, or you are not sure, you can consult with an attorney at our office who can advise you. If you are not being paid the proper wage, we can represent you to change this. We will generally begin by writing a letter to your employer demanding that you receive your proper pay. If the employer does not respond adequately, we are prepared to file a lawsuit and represent you in court.
  • If the employer fails to obey the wage laws for a group of employees, Raff & Becker, LLP attorneys are also able to represent groups of employees in these claims.

Contact our New York wage and hour attorneys at Raff & Becker, LLP today to discuss your case. We can assist you in standing up to your employer to ensure you are being paid the proper wages.
