The laws protecting gay, lesbian, bisexual, and transgender individuals are complex, but protections do exist. Despite this, many employers still engage in unlawful discrimination against employees based on their sexual orientation or gender identity.

New York State's Sexual Orientation Non-Discrimination Act ("SONDA") prohibits discrimination on the basis of actual or perceived sexual orientation. Additionally, New York City has banned gender identity discrimination and the governor of New York State has issued an executive order banning discrimination against transgender state workers. On the other hand, federal laws protecting employees from discrimination due to sexual orientation and gender identity are slow in coming, and recent federal court decisions have raised questions about the extent to which federal laws against discrimination based on sex also apply to discrimination based on gender identity.
