When is Bullying at Work Illegal?

Bullying in the workplace is unfair, but unfortunately, not always unlawful. At present, only bullying and unfair treatment resulting from illegal discrimination, filing wage and hour claims and unfair labor practices complaints, and violations of other employment laws are illegal.

For example, bullying and unfair treatment at work constitutes unlawful discrimination when it is occurring because of someone's race, color, religion, age, national origin, alienage, citizenship status, gender, sexual orientation, disability, marital status and partnership status and any other legally protected characteristic. It can be anything from verbal harassment, such as insensitive comments or jokes, to poor evaluations without merit that can block your advancement, to unwelcome physical conduct.
